Terms and Conditions

We make every effort to provide you with the best services in a pleasant atmosphere at all times. We strive for your complete satisfaction to provide a safe, secure and enjoyable journey without any misunderstandings between the tour escorts, the Company and you at any time. The tour registration form and any other printed material, advertisement and brochures form the basis of our contract with you. You are required to read, understand properly and accept all the terms and conditions, before you register yourself/ family/ friend for any of our tour(s).

Definitions – “Clients” means the person/ persons in whose name/ on whose behalf booking or registration is made. ”Company/ We/ Us” means DND Trips Private Limited and also includes all its brands and divisions. “Brochure” means tentative products for sale. Both these terms can be used interchangeably. “Group Tours” mean such tours which are carried out in groups containing various individuals families and where the services provided are similar to all the guest/s in that group. “First day of the tour” shall start at any time (i.e. in the morning / afternoon / evening) at the first destination depending on the arrival of the respective flight/train/cruise or any other mode of transport and the same shall be in case of the last day of the tour. In other words, a ‘Day’; shall mean a part of the day or 24 hours or its part thereof. “Independent contractor” means any hotelier/ hotel owner, owner of any airlines or shipping Company or Bus supplier or Railway or Ferry Boat/ Cruise/ Coach owner/ operator or any other person or organization who has been selected by the Company to render services to the Passenger (s) and who has agreed to render services to the Company. “Force Majeure” means an event or circumstance not within the reasonable control, directly or indirectly, of us in its ability to perform its obligations/ responsibilities regarding the tour including war, possibilities invasion, act of foreign enemies; rebellion, revolution, insurrection or military or usurped power or civil war; epidemic, explosion, fire, flood, earthquake or other exceptional natural calamity and act of God; ionizing radiation or contamination by radioactivity from any nuclear fuel, or from any nuclear waste from the combustion of nuclear fuel, radioactive toxic explosive, or other hazardous properties of any explosive nuclear assembly or nuclear component of such assembly; riot, commotion or disorder; any act or omission of any Government instrumentality; a Change in Legal Requirements; strikes, lock outs or other industrial disturbances and abnormal weather or sea conditions including tempest, lightning, hurricane, typhoon, rain & temperatures. “Extra Mattress” Means roll away mattress which is on floor (For domestic tour extra mattress & for international tour extra bed). “Jain Food” means: Food without onion, garlic served at the time of tour groups meals and not necessarily before sunset, it may or may not be served on the table. “Tour Escort/ Leader/ Manager” means person (s) who assist/ guides tourists on tour/trips or guide with information about tourist attractions.

General Explanations – Each provision/term of these Terms and Conditions shall be severable and if any provision thereof is declared invalid, illegal or unenforceable, then remaining provisions nevertheless shall have full force and effect. Unless the context otherwise requires words, importing the masculine gender, shall also include feminine gender and vice versa, and the use of the singular shall include plural and vice versa.

Guest’s signature on the booking form or payment of the registration/ booking amount whichever earlier shall mean acceptance in totality of the ‘Terms and Conditions’ contained herein by the guest (s). In case of one or more, but not all guest (s) signing the ‘Booking Form’, it shall be deemed that the others have duly authorized the concerned signing passenger/ s and everybody shall be deemed to have been bound by the Terms and Conditions mentioned herein. There is no contract between the Company and the guest (s) until the Company has received the initial registration/ booking amount. The initial deposit just ensures a seat or participation on the tour but does not entitle any of the services such as air tickets, visas, hotel accommodations, until the full tour payment has been received by the Company. The full payment must be received in accordance with the procedures laid down by the Company. If full payment is not paid in time, the Company reserves the right to cancel the booking with subsequent loss of deposit and apply the cancellation charges as mentioned herein.

Scope of Activity – Company as an organization is co-ordinating with various independent service providers for conducting the tour. The company takes utmost precaution to ensure that the tour is comfortable. Also, Guests are updated from time to time through different media of communication in case of changes. Though we take maximum care, neither we have control on the mode of transport like shipping, Airline, railways, coaches, buses etc nor on the hotels, restaurants or any other facilities. Thus as a company we shall not be responsible for any kind of damage to the person or to the property because of these independent vendors.

Brochure Accuracy – This brochure along with tour tariff is published in July 2016. All previous brochures, letters and any other modes of circulation shall stand cancelled with immediate effect. Every effort is made to ensure brochure accuracy during publication, based on the available information at the time of publication of the brochure. Yet errors and omissions may creep in. The maps used in any brochure are inserted solely for convenience and are not to scale. The distances, temperatures and pre/ post tour accommodation prices given in the brochure are approximate and subject to change. Photographs of meals and sightseeing printed in this broacher are for reference only and may differ from the actual meals served/sights. We reserve the right to change any brochure information before or after a tour is booked, due to occurrence of any events beyond our control. Tour itinerary, tour price, departure date and hotels are subject to change. If we are aware of these changes sufficiently beforehand, we will inform you in advance. Otherwise, our tour escort or local representative will inform you of the changes on tour.

Coach – Seating arrangement in the coach shall be strictly as per the booking date i.e. the guest who books first will get the first seat and so on. In coach, the seating allotment shall start from seat number 5 onwards as first two seats are reserved for the tour managers & seat nos. 3 & 4 are reserved as Prime Seats which if available can be booked by the guest at an additional cost. The company reserves the right to allocate Prime seats. If paid and prime seat is not available due to any reason, company is liable only to refund the amount paid for the prime seat. There is a strict “no smoking”, “no alcohol” and “no eating” policy in the Coach. Guests are advised not to keep valuables in coach while sightseeing. The Company shall not be responsible for the loss of valuables from the coach. If the coach is accidently or otherwise damaged by the guest he/she will be required to pay the compensation for the same.

Transport – We use vehicles such as Tempo Traveller, Tata Winger, Chevrolet Tavera, Mahindra Scorpio, Toyota Qualis, Tata Sumo, Innova, Etios, Indigo  etc. as per the availability of vehicles and actual number of travelers / size of the group. We will not be responsible or liable in case of theft or robbery of the said items from the coach. All baggage and personal effects are at all times and under all circumstances your responsibility. Any damages caused to the hotel rooms / coach during your stay, shall be payable by the Clients and the Company will not be liable for the same. The drivers of the vehicles are bound by specific rules like maximum driving hours within a day/during a week, rest period per day/week etc. Clients will have to strictly adhere to the prescribed timetable for the day so that the driver can complete the travel. In case, any of the sightseeing schedules is missed due to delays caused by the client, the same will not be refunded to the client under any circumstances

 

Baggage – Guest/s are responsible for their own baggage. The baggage at the airport, during any air travel, in coaches, in any train journey, at immigration point’s etc., guest/s have to verify and be responsible for the same. The tips for services rendered to carry guest/s baggage to the rooms is guest/s responsibility and have to be paid directly to the service provider. The “porter” or any helper arranged by the guest/s at any train stations, airports, at immigration points or any other place, is the sole responsibility of the guest/s and guest/s shall have to pay tip directly to them.

Hotels – Single guest provided with single occupancy/single bedded room have to pay single occupancy charges for the entire tour. Single rooms are comparatively smaller in size than the twin sharing rooms and may be located on a different floor or in corner side from the rooms of other group members. Guest have to abide by the check-in and check-out time of the respective hotels. For Indian tours, generally the check-in time is 12 noon and check-out time is 10 am. For World tours, generally the check-in time is 3 p.m. and check-out time is at 12 noon. If guest wants any change therein, like early check-in or late check-out, he/she will have to manage the same on his/her own with hotel authorities on payment of additional charges, if any. Any loss to hotel property knowingly or unknowingly will have to be borne by guest. Company shouldn’t be held responsible. Single person joining the tour may be given a sharing partner/s in twin, triple or four sharing basis & this is subject to availability of the room partner of the same gender. However, any misunderstandings or incidences like missing items or difference of opinion between each other will have to be settled between room partners themselves. The company is not responsible for any loss or mishap. If, for any reason, concerned partner cancels or alters the booking of the tour, then the other guest / partner has to bear entire room charges. No adjustments shall be made from the money contributed by guest / partner who has cancelled the tour. Shared rooms have ‘No Smoking’ policy. Cleanliness of the room and especially the bathrooms is to be maintained under any circumstances. Any Religious thing one does shouldn’t be botheration or force to other. Safety of money and valuables is own responsibility even one has to take care oneself and other person should not be forced to help or assist. Laundry, telephone, mini bar, alcohol, beverages and food not on the menu, optional excursions, excess baggage fees, shopping, paid toilet, are all items of a personal nature. These additional services, if availed by the guest, will be charged separately to the guest and shall be paid in full by the guest before leaving the hotel, ship/cruise or restaurant by the concerned authority. The Company shall not bear any liability towards the same.

Itinerary Changes and Unavailability of Sights – The Company reserves the right to modify or alter the tour itinerary in case of force majeure conditions. Changes shall be informed to the guests at the earliest. Any additional charges, if applicable, are to be paid by the guest. Other than force majeure, for any other unavoidable circumstances, if the company curtails or cancels a certain day’s sightseeing, refund for the concerned portion of the sightseeing/tour shall be given to the guest. The Company will not be responsible for any kind of claims. The Company reserves the right to change (addition/deletion on exchange) sightseeing places for betterment of the tour program. If sightseeing timings aren’t adhered to, or if any add-ons are required then the same will be borne by the guests. Sightseeing days and closing of a particular sightseeing place are not in our hand, but we try our level best to cover all the sightseeing listed in the tour program. In case if any sightseeing is closed we may give you a replacement of that place or refund may be given for that particular sightseeing place only. Sightseeing of adventurous type are totally dependent on weather. In case, the weather turns out to be unfavourable & sightseeing is not possible, refund will be given. Airline Companies change their flight schedule due to varying economic conditions, political situations and demand. Such changes in the airline schedules may directly/indirectly create an impact on our tour itineraries, accordingly the Company reserves right to change its schedule due to such circumstances beyond its control. Such changes shall also cause variation by way of alterations/ additions in the tour program. City tour includes panoramic view of sightseeing places as mentioned in tour program. Unless specially mentioned from inside, it stands as panoramic view or photo stop.

Meals – There is mostly a pre-set menu for meals depending on the tour program. Packed meals are served at some places. The Company mostly serves Vegetarian food along with few Non-Veg items. We do not differentiate amongst the guest/s by providing a special meal or special diet. In case of a baby meal, the Company generally provides tin milk, baby food, (we appreciate a prior intimation) Apart from that if any different diet is required, the said guest/s shall make their arrangements for the meal at their own costs and consequences. In case if any we treat which is mentioned is not available, an alternate shall be given and no refund shall be applicable. No Complaints / Claims for refund in respect of the meals shall be entertained and Company reserves the right to change the menu and arrangements of the meals without assigning any reasons therefor.

Payment -Minimum Booking deposit amount or Registration Amount is 25%. All cheques / demand drafts to be payable in the name of ‘DND Trips Private Limited’. On payment of the deposit amount you will be given an official receipt from DND TRIPS. The registration amount paid at the time of booking is not refundable and interest free. Guests have to pay the full tour price as per the guidelines given in the brochure. If guests fail to pay the final payment as per the instructions, we reserve the right to cancel the reservation. In case of a cheque paid by the guest in favour of the company is dishonoured a charge of Rs. 300 per cheque must be paid. If a Guest books a tour just 30 days prior to the departure date, he/she should make a payment of the entire amount. Also, the amount should be paid by demand draft or cash. When the tour cost is quoted, the Foreign Exchange component is calculated as per the prevailing rate of that day. The company reserves the right to alter the cost of the tour before the departure, accordingly the guest will have to make the full payment before tour departure. Tour costs do not include government or other taxes raised by independent contractors like airlines, which are to be paid by the guest as per the actual. Guests can avail early booking discounts declared by the company, which are valid for a declared period only and are applicable for limited seats or for the particular dates as specified. The company reserves all rights to make changes in the discount policy at any point of time without assigning any reason. Airline is an independent vendor. The Company does not have any control on their operations; neither on the increase in air fare, fuel or any other taxes like YQ & YR etc. All such hikes have to be paid by the guest before the tour departure. Air Ticket Cancellation charges plus deposit forfeit charges applicable under the rules of the concerned Airline are to be paid by the guest immediately in the event of cancellation of the tour. All tour prices are exclusive of service tax, any other government taxes applicable from time to time.
Please note: A 2% payment gateway charge will be levied on the balance payment made using credit/debit card.

Documents – All guests are advised to carry the photo identification in the form of driving license, election ID card, PAN card and students must carry with them their school / college ID card. All travel documents are not transferable. At certain sightseeing places, the Identification proof is mandatorily required and company has no control over it. The identification documents must be produced by the guests as per the rules and regulations prescribed at different locations. Also, please ensure that on tour you carry the same photo ID submitted in the office. In case of documents being in maiden name, provide & carry those documents. It is the guest (s) responsibility to collect in time, their necessary travel documents or other documents from the booking office, which makes them eligible to travel on tour.

Health and Safety – Please be aware that during your participation in vacations operated by us, certain risks and dangers may arise beyond our control, including but not limited to: the hazards of traveling in undeveloped areas; travel by boat, train, automobile, aircraft, or other means of transportation; forces of nature; political unrest; acts of lawlessness or terrorism; and accident or illness in remote regions without means of rapid evacuation or medical facilities. In the event of a medical condition has not been disclosed, the Company will not be able to provide any assistance or money back and no further claims in this regard will be entertained. Guest should not hold Company liable/ responsible for any reason whatsoever it may be, for settlement of claims. We will not have liability regarding provision of medical care or the adequacy of any care that may be rendered. While we will use its best efforts to ensure that adequate measures are taken, by agreeing to participate in a vacation and/or optional excursions you agree that you will hold us harmless regarding any provision of medical care or the adequacy of any care rendered. We are not responsible for such risks and dangers that may arise beyond our control. Payment of your deposit indicates you accept these risks and dangers and agree to hold us harmless for such.

Transfer of Tour – A transfer from the originally booked tour to another tour will be treated as cancellation of earlier tour and a fresh booking of another tour will have to be made. All cancellation charges stated in the Brochure will apply. Cancellation charges will be charged as per actual tour cost & not on a discounted tour price. Tour price and discounts existing on the date of fresh booking will be applicable.  Minimum group size requirements – In case the number of guests falls below the stipulated number and the Company decides to operate the tour with available participation. However, Company may cancel the tour without assigning any reason and in such an event the guest(s) can claim only the amount paid by him after deducting the taxes. If the passenger (s) is required to travel as ‘Individual Traveler’, the Company reserves the right to collect additional amount from the guests. Passenger (s) traveling as individual travelers in such cases will not be provided certain services including that of tour escorts, group activities, meals and the passenger (s) may travel with some amendments, such as seat in coach (SIC), airport transfers which are at fixed times, etc.

Single Traveler and Discounts – Guest traveling alone must pay single supplement charges if a suitable partner for double/ triple sharing is not available or the earlier partner cancels the tour before the tour departure. Single person not willing to pay single occupancy charges will have to share a room with two or three co-passengers, subject to availability and rules of that respective hotel or else has to wait till the willing person books the tour. The Company reserves the right to amend, alter, vary or withdraw any of the discounts/ benefits without prior intimation. The discounts are valid for limited number of seats and limited period for limited dates only. The discounts given to the guests will be at the sole discretion of the Company and may vary from guest to guest and for bookings done on different dates for the same tour.

Cancellation by Guest: If the guest decides to cancel the tour for any reason whatsoever then she/he shall give a written application to the company within a specified time limit along with the original receipt issued by the Company. Such cancellation will attract the cancellation charges stated hereunder. Cancellation charges will be calculated on Gross Tour cost and the cancellation charges shall depend on date of departure & the date of cancellation. Cancellation charges for any mode of transport ticket are applicable as per the rules of the concerned authority. Air ticket is issued on special fare are non-refundable and the guest shall bear cancellation charges. Any refund payable to the guest will be paid after the company receives refund from the respective authorities. The company deducts processing charges from the refund which is to be paid to the guest.

Note: Charges are levied on the Gross tour price and not the discounted price. For tailor-made holiday, cancellation charges will defer accordingly as per services booked. When the Company cancels a tour – If any Tour is cancelled from the Company’s end, then the full refund of amount paid by the guest will be made within 7 working days of cancellation of the tour by cheque or bank transfer. The tour may be pre-pone/ post-pone by the company in certain circumstances which are beyond its control like earthquake, epidemic or any other natural calamity, political disturbance, security problems etc., and guest agrees to co-operate with the company’s decision and make necessary suitable adjustments.  In case of cancellation due to major mishaps like Death in Family/Accident, Credit note will be issued against deposited amount, which can be utilized within 1 year from the date of booking. In such cases, guests are required to furnish Death/Medical Certificate.

Refund – Refunds if any, for amendments and/ or cancellations will be paid directly to the guests strictly by ‘A/ C payee’ cheque or Bank Transfer in Indian Rupees at the prevailing rate of exchange within 45 days, as per Reserve Bank of India Rules and Regulations, irrespective of whether the tour payments were in part or whole in foreign currency. No refund will be payable, for any unused portion of the tour, due to whatsoever reason. No refund will be made in cash.

Medically Unfit Traveler:If any guest is suffering from any serious kind of a medical ailment, which may be a concern to some or all co-passengers traveling on a group tour, then the company reserve full right to restrict that particular guest from traveling on group tour with Company.

Travelers needing special assistance: Company will make reasonable attempt to accommodate the special needs of disabled travelers/ senior citizen’s if informed at the time of booking, but the Company shall not be held responsible in the event of it being unable to do so, nor shall be responsible in case of any denial of services by carriers, hotels, restaurants, or other independent suppliers. We cannot provide individual assistance to a passenger(s) for walking, dining, getting on and off motor coaches and other transportation vehicles, or other personal needs. A qualified companion must accompany travelers who need such assistance.

To Hold Company Harmless and Indemnity – The Company shall in no circumstances whatsoever is liable to the guest or any other person traveling, for any loss or expense incurred due to:

  • Any death, personal injury, sickness, accident, loss, delay, discomfort, increased expenses, consequential loss and/or damage or any damage to baggage or personal effects howsoever caused;
  • The coach drivers, mostly on international routes, are bound by specific Rules. Any sightseeing missed due to delay caused by any passenger shall be non-refundable.
  • Train/flight delays, rescheduling/ cancellation of train/flights, inter-connection occurring due to airline problem and/ or any change in train/ flight schedule or meals not being served; We are also not responsible for any alternate arrangements and the guest has no right to claim any loss or consequences arising due to the same.
  • Any overstay expenses due to delay or changes in air, bus, ship, train or cancellation of special bogie or other services due to sickness, weather conditions, strike, war, quarantine, or any other cause whatsoever.
  • Sightseeing missed and/ or the program being curtailed after commencement of the tour and/ or before the due period due to any unavoidable circumstances and any reason beyond our control such as political, natural calamity, monument under renovation, heavy rush at sightseeing places, road traffic congestion etc.
  • All the loss or expenses will have to be borne by the guest arising in any way out of this contract in respect of any tour; holiday, excursion facility which exceeds the total amount paid or agreed to be paid for the tour, and shall in no case include any consequential loss or additional expense whatsoever. If in the event of the guest(s) is booked on a particular train/ airline on a particular date and due to certain reasons beyond the control of the Company the guest (s) is not allowed to board the train/flight, the guest (s) shall not hold the Company responsible for the same and no claim whatsoever can be made by the tour participant against the Company. The Company shall not be responsible and/ or liable for any damage or loss caused to the guest (s) due to reasons beyond the control of the Company. The Company is not liable for any loss due to negligence or technical fault or any other reason whatsoever due to change amendment or cancellation by Airline/Railway Authority.
  • The Company shall not be responsible for any loss of baggage by the airline or by independent contractor or their agents, hotel staff, bus/ coach or while traveling etc.
  • The company shall not be responsible if any guest’s baggage, cash, Jewellery or any other valuable (s) is lost due to theft or by any other reason whatsoever during the tour. Entire responsibility of taking care of their valuables shall lie on the guest (s).
